According to NASCAR, JC France won his case after a judge decided, on France's request, to throw out the evidence because the officer which pulled over France did so for an infraction which happened outside his jurisdiction.
France was arrested together with his housemate, Russell Van Richmond, who was also charged with threatening a female officer.
The two were stopped by police for racing over the Seabreeze Bridge in Daytona Beach. Reports say France was driving a Lamborghini and Richmond a Porsche Cayenne. Once stopped, police found both France and Richmond were driving under the influence and more, they were in possession of cocaine.
At the time, Grand Am decided to issue a penalty notice and suspended JC indefinitely from all competition for actions detrimental to racing. Although the penalty is not appealable, it remains to be seen whether the decision taken by the court on March 29 will have any effect on the suspension.
