Volkswagen’s American division hired renowned attorney Kenneth Feinberg to help resolve claims made by owners affected by the Dieselgate scandal.
Ken Feinberg is the lawyer who also handled high-profile cases such as BP’s oil spill in the Gulf of Mexico, the September 11 victim fund, the massacre at Virginia Tech, General Motors’ ignition switch recall settlement, and many others.
The new attorney hired by Volkswagen of America will have to help review and resolve claims filed by owners of VW-made diesel vehicles with illegal emissions software. We’re talking about the vehicles equipped with the famous “defeat device” that started the whole Dieselgate scandal. Mr. Feinberg’s job will be to develop and administer a program to address claims made by owners of Volkswagen 2.0 and 3.0 TDI-engined vehicles that are eligible for this situation.
The program made by Ken Feinberg will be operated independently from Volkswagen of America, but will receive input from the company, VW vehicle owners, state regulators, other interested parties and, naturally, their attorneys.
In the first statement made in his new temporary function, Ken Feinberg has said he anticipates developing a “menu of remedies” for the program. This means that the owners of affected vehicles will be required to have the cars fixed in VW workshops for the future recall campaigns to be eligible to participate in the compensation program. However, the attorney noted this “menu of remedies” program was just an early personal assumption and not necessarily his final plan for the situation.
Michael Horn, Volkswagen of America CEO, announced that they would contract Kenneth Feinberg on December 17, 2015, Automotive News reports. The decision to hire him was motivated by “his extensive experience in handling such complex matters.” According to Horn, Volkswagen of America wants to make things right for its customers and they feel this settlement program will be the best option for all parties involved.
