Biller Loses to Toyota

In 2009, as if the financial and recall difficulties Japanese manufacturer Toyota was experiencing weren't enough to make its top brass anxious, another brick was hanging dangerously close over the car maker's soft head: Dimitrios P. Biller.

A former Toyota US employee, Biller tried to make the most out of the car maker's recall problems and accused Toyota of several nasty things, including hiding and destroying evidence regarding rollover accidents.

The entire story now spans for well over a year, with more twists and bends than we can count. This week, however, the arbitrator in the Biller vs. Toyota case made his decision and, sadly for the former Toyota employee, things aren't looking very bright for him at this point.

The arbitrator granted Toyota’s motion for summary judgment and dismissed Biller’s RICO claims ruling against his claims of defamation and fraud and/or false promises. The former employee has been found liable for breach of contract, conversion and statutory unauthorized computer access.

What's worse for Biller, he is now forced to return the Toyota confidential documents and was prohibited from making future wrongful disclosures of confidential Toyota information. Toyota, as you might have guessed, is very, very pleased.

“Toyota takes its legal obligations very seriously and works hard to uphold the highest professional and ethical standards. We are gratified that the credibility of Toyota’s legal organization and the integrity of our legal professionals have been validated,” the car maker said in a statement.

“We believe that the Arbitrator’s award clearly vindicates Toyota’s position and reaffirms the critical importance of attorney-client privilege as a cornerstone of our legal system. Throughout this process, Mr. Biller has continuously made misleading and inaccurate allegations about Toyota’s conduct, and we feel this award is an appropriate consequence of his actions and completely discredits his meritless attacks on our company and our people.”
