New Jersey Motosrports Park Takes American Car Club to Court

During a time when money is badly needed, in case you don't pay the bills, the logical consequence is that you're taken to court.

This time, we speak about the Shelby American Automobile Club which happens to have been the one and only club in the New Jersey Motorsports Park's inaugural season, now preparing for a tough lawsuit.

The Motorsports Park was opened in July last year and now is suing the car club for more than $115,000 for track rentals and other fees linked to the club's August race weekend, Autoblog reports via The Daily Journal.

According to the lawsuit, the two sides concluded the contract on April 22 and SAAC made a deposit payment of $9,375 for the track rental on April 10 and a $14,200 deposit for VIP suites and garages rental on May 23. The rest of the money was supposed to be paid by the club 30 days before the event, but Eber asked the Motorsports Park if he could make the payment at the end of the three-day event, because  not all participants had paid until then. They gave their agreement but the day he must have completed the payment, Eber was no where to be found.

Yet, the club claims it's only a misunderstanding since they have already solved the problem and a 2009 program is going to be prepared.

"We have a verbal agreement with New Jersey Motorsports Park to resolve the issue,"  Kenneth Eber said national director for the club. He added that he hasn't yet seen the lawsuit.

In what seems to be a non-reaching conclusion debate, everybody tells his side of the story. Motorsports Park co-owner Joe Savaro told the newspaper the track is in negotiations with the SCCA for a 2009 date, but he refused to comment further or speak about the lawsuit.

Another key-person who refused to comment on the matter was the Motorsports Park's attorney Kyle Culzer.

Truth seems to be somewhere in the middle and is likely to come to light soon. In the meantime, Club officials don't stop speaking about their interest in the Motorsports Park, Eber saying the club is committed "more so than ever" to the facility.

"We want to grow it each year and make it a major event on the East Coast," he said of their convention. "We're looking forward to next year as are they."

However, we have the impression that the Motorsports Park is not so eager to host their races any longer...
