Walmart Blames Tracy Morgan for His Injuries in the Deadly Crash

Walmart has recently filed a 28-page response to the complaint Tracy Morgan’s lawyers and three others made for the accident that left him seriously injured and killed his friend Jimmy Mack. The retail corporation now claims Morgan should’ve worn his seatbelt and that the injuries he had suffered are his fault.

The actor and renown American comedian is still recovering from the injuries he suffered in the six-vehicle accident that went on in New Jersey, on June 7th. Not only the former Saturday Night Live star was severely injured, but his close friend comedian Jimmy Mack sadly pasted away shortly after their limo bus was hit by a Walmart truck.

The retail corporation’s lawyers now claim the injuries Morgan suffered are his fault as the comedian was not wearing the seat belt at the moment of impact. Moreover, police said a truck driven by Walmart employee Kevin Roper was the one to collide the rear of the vehicle Morgan and his team (who were on tour at the time) were riding. About that, Walmart won’t even confirm the driver of the truck was an employee.

According to CNN, Morgan’s lawsuit said Walmart was careless and negligent in the operation of the vehicle. It said the company should have known Roper had been awake for more than 24 hours at the time of the accident, and cited Walmart for not complying with Federal Motor Carrier Safety Administration Regulations enacted to combat the dangers of driver fatigue.

The preliminary report concluded that the Walmart truck was traveling 20 mph over the speed limit. In its response, however, the retailer claims the injuries were “caused, in whole or in part, by plaintiffs’ failure to properly wear an appropriate available seat belt restraint device.”

We’ll remind you Tracy Morgan team along with his longtime friend, comedian Hame McNair, were on tour riding in a limo bus in New Jersey, in June, when a truck slammed into the the rear of their vehicle. The crash killed McNair and injured the other passengers. Morgan was hospitalized with broken ribs, a broken nose and a broken leg.
