61-year-old BMW driver Kenneth McKay from South Shields, United Kingdom, has been prosecuted for inattentive driving after he overtook four vehicles at once, one of them being a police car.
The driver was visited at home by police officers after they noted down his registration number when he performed the dangerous maneuver.
Accusers said that the driver was first noticed on Newcastle Road, heading towards Cleadon from Sunderland. At Cleadon Village “he overtook about four vehicles, including the police car, while driving on the other side of the road beyond a bollard separating the lanes.”
In defense, McKay’s legal representative said that "he overtook a number of cars at speed. It was inappropriate, but there was never anything close to a collision” and that “no one had to take evasive action to get out of his way – this is careless, not dangerous, driving.”
The trial ended with McKay receiving six penalty points, a £240 fine and an additional £124 in costs and victim surcharges by magistrates.
