According to TMZ, the three companies are responsible for producing "pain and suffering, psychological and emotional distress and disfigurement and pre-impact fear of death and burning."
Barker is complaining the plane itself was defective: "Its landing gear, tires, wheels, brakes, reverse-thrust system, squat switches and component parts were not airworthy," the lawsuit says, according to TMZ. "One or more of the tires failed, leaving tire debris and portions of airplane components along the 8,600-foot runway."
Investigations upon the crash have shown the accident might have been caused by a blown tire. That's why Goodyear Tire & Rubber Company is also on Barker's prosecution list. Moreover, according to the audio-tapes from the incident, it seems that pilots are guilty of casualness in their attempt to abort the taking off.
The accident resulted in the death of four out of the six people on the plane: Barker's assistant, Chris "Little Chris" Baker, 29, of Studio City, California (who played in MTV's reality show "Meet the Barkers"); Barker's bodyguard, Charles Still, 25, of Los Angeles; the plane's pilot, Sarah Lemmon, 31, of Anaheim, California and her co-pilot, James Bland, 52, of Carlsbad, California. Barker and Dj AM (born Adam Goldstein) were severely injured, first suffering burns from waist down and second being burned on the face. The night the incident took place, the two were returning from a T-Mobile-sponsored show in the Five Points area.
