Lawyer Claims DUI Laws Discriminate Against Women

Men and women are different and we all know this for a fact. However, we never thought that women reach the same blood alcohol concentration as men after drinking nearly half as much.

At least that is what some Italian researchers found out. Well, based on that study, a Los Angeles attorney claims that the current DUI laws discriminate against women.

According to the aforementioned study, women reached blood alcohol levels illegal in a DUI case after drinking 20 to 30 percent less alcohol than men of equal weight. Therefore the scientists concluded that legislatures need to consider sex differences in drafting DUI laws.

The lawyer, Lawrence Taylor, cites another study to support his cause. According to the scientific journal Analytical Toxicology, women have lower partition ratios than men, which means that with a true level of 0.06% and a ratio of 1500:1 will produce a reading on the breathalyzer of 0.09% and that is above the legal limit.

Taylor says the breathalyzer will show an average man accused of drunk driving to be innocent, but a woman with the same blood alcohol level to be guilty.

And the lawyer’s arguments do not end here, as birth control seem to be a problem also. Canadian scientists found out that women taking oral contraceptives appeared to reach peak blood alcohol levels faster than women not taking them. Moreover, their breath contains higher levels of acetaldehyde, and breathalyzers are not able to tell them from alcohol. That could also lead to a false DUI conviction.
