One tends to see many people driving around while wearing headphones, yet very few people ask themselves whether or not it is legal. The short answer is ‘it depends’ on which state you’re in. For instance, in some states it’s only legal to wear headphones in one ear, not both, and the level of acceptance varies from 'mostly legal' to 'mostly illegal'.
According to the new interactive map created by the American Automobile Association, in 33 states wearing headphones or ear buds is ‘mostly legal’, while 13 other states have been given the ‘it’s complicated’ denomination. In the latter category, the law in Washington State for instance states that ‘it’s illegal to wear headphones and ear-buds while driving [...] unless those headphones are built into a helmet, or it’s a Bluetooth headset.”
In the four remaining states of Colorado, Louisiana, Maryland and Rhode Island, the act of wearing headphones is ‘mostly illegal’, and if you ask us we would advise against it, as some ear-buds, specially those which when put inside your ear cancel any and all background noise, make you less aware of your surroundings and the likelihood of crashes increases.
