Kevin Harvick, the winner of the Aaron’s 499 race at Talladega is being accused by Felix Sabates, part owner of Earnhardt-Ganassi Racing, of illegally passing Jamie McMurray and winning the Sunday race.
Sabates says Harvick went below the yellow line when he passed McMurray on turn four on the final lap. McMurray says this might be case, but he's not entirely sure, as he was more focused on the race.
"Harvick was below the yellow line,” Sabates said according to The Examiner. “They either have (the rule) or they don’t have it. He was definitely below the yellow line."
"That’s just pure b.s. It’s just b.s. He was below the yellow line when he passed. He passed Jamie under the yellow line and the rule is very specific. You pass below the yellow line, you’re the last car on the lead lap.”
“I think he think he’s the 29 went below the yellow line,” McMurray added. “And I don’t really have a comment because I didn’t see anything. I was more concerned with side drafting the 29 then where we were on the race track. You live for those moments, coming off of turn 4 at Daytona trying to get to the start/finish line and the same thing here, that’s what every kid dreams of getting to do.”
The general feeling however is that Harvick did not go below the yellow. So far, NASCAR handed the driver no penalties for the alleged illegality.
