Court: Martin Eberhard Not One of Two Tesla Motors Founders

The battle between Elon Musk and Tesla Motors on one side and Martin Eberhard on the other continued today with a ruling by a San Mateo County Superior Court judge. Eberhard's request to be named one of only two Tesla Motors founders was struck down by the aforementioned court, in a ruling which Tesla says "is consistent with Tesla’s belief in a team of founders."

We agree that Eberhard’s claims on the question of who founded Tesla have no merit,” Elon Musk said in the release. “We look forward to proving the facts in court as soon as possible and setting the historical record straight.”

The battle between the two officials began a while back, when Musk accused Eberhard for cost overruns and delays on the Tesla Roadster. As a result, Eberhard, now former Tesla CEO, filed a defamation lawsuit against Musk.

Things got hilarious and childish when Eberhard began accusing Musk he may not have received his undergraduate degrees or been accepted to graduate school.

"Tesla has asked that Eberhard, a former CEO of Tesla, revise his original lawsuit and delete some of the most outrageous and demonstrably false assertions that Musk may not have received his undergraduate degrees or been accepted to graduate school," Tesla's release added.

"Such statements are easily proven false through online degree verification services or other simple fact checking, and they illustrate the degree to which the original lawsuit by Eberhard is a fictionalized account of Tesla’s history."

Elon Musk was asked by the latest Tesla investor, German manufacturer Daimler, to remain in his current position until 2011, to see through the development of the upcoming Model S.
